Chemical tests, like the Intoxilyzer, are used to provide an objective standard by which the degree of impairment can be measured in order to determine whether or not a police officer should charge a driver with DUI. A person’s blood alcohol concentration, or “BAC,” routinely is used as an objective measure of intoxication. In most states, a specific BAC level may constitute a per se offense or create a presumption of sobriety or impairment, which may influence the judge or jury in discretionary areas.
Maine law provides for a person’s BAC to be determined by chemical analysis of the person’s blood, breath or urine at the discretion of the police officer.
How many drinks does it take to get a blood alcohol level of .08%? That depends on a lot of different factors, such as your age, weight, sex, amount of food in your stomach.
Alcohol affects people differently. Your subjective feelings of impairment may be affected by your age, gender, physical condition, amount of food consumed, number of drinks and any drugs or medication consumed. In addition, different drinks may contain different amounts of alcohol, so it's important to know how much alcohol they contain and the concentration of alcohol you consume.
Impairment begins with your first drink.
For safety's sake, never drive after drinking!
